Labour Law for Hawaii Employers - Prevention and Risk Reduction

Labour Law for Hawaii Employers - Prevention and Risk Reduction Policies and Training

It is well established now under federal Headline VII law that an company is responsible for workable sex-related nuisance brought on by a manager with "immediate (or successively higher) power over the worker." However, in situations where the worker does not suffer a "tangible occupation activity," such as release, demotion, or an undesirable reassignment, there is an positive protection that an company may raise to prevent Headline VII responsibility and loss.

Under such positive protection whether an company has an anti-harassment plan is appropriate evidence. Also important is efficient supervisory training and training of workers on the nuisance plan and issue process.

Training and academic programs for all workers take on an even greater degree of significance under Hawaii islands condition law, HRS Section 378. State guiidelines currently is considered by the Hawaii islands Municipal Privileges Commission payment ("HCRC") as mandating tight responsibility for sex-related nuisance dedicated by managers.

While the Hawaii islands Superior Judge has not resolved the HCRC's presentation of HRS Section 378 a recent Celui-ci Superior Judge choice upheld a Celui-ci Human Privileges Commission payment judgment dealing with a control similar to the HCRC's--that an company was totally responsible for a supervisor's unwanted perform under Celui-ci condition law even though the manager did not even have direct supervisory power over the Complainant.

The Apr 16, 2009 Celui-ci choice will certainly be powerful power to a Hawaii islands Superior Judge experienced with decoding the HCRC's control. Accordingly, it is critical that Hawaii islands employers comprehend the value of having an efficient plan and company-wide workout on not only a protection to a sex-related nuisance claim, but prevention.

I. The Significance of Having an Effective Harassment Policy

A. The Faragher/Ellerth Defense

Having an efficient sex-related nuisance plan and workout will significantly increase the chance of preventing responsibility under the positive protection for sex-related nuisance statements identified by the U.S. Superior Judge.

Where claimed nuisance by a manager does not end in an negative ("tangible") occupation choice, the company may prevent responsibility by displaying that: (1) the company worked out affordable care to prevent and quickly correct any unwanted behavior; and (2) the complaintant unreasonably did not take advantage of any precautionary or remedial possibilities provided by the company to prevent damage. "A concrete occupation activity is really a considerable modify in occupation position such as choosing, shooting, unable to market, reassignment with considerably different obligations or a choice causing a considerable modify in benefits."

The significance of the positive protection was considerably improved by a U.S. Superior Court's choice in which the Judge organised that the protection is available in beneficial release situations unless the complaintant leaves in a affordable reaction to an employer-sanctioned negative activity of an formal characteristics, such as a demotion or a cut in pay.

A zero-tolerance nuisance plan must fit the environment and employees:

While evidence that an company had promulgated an antiharassment plan with issue process is not necessary in every example as a matter of law, the need for a stated plan appropriate to the occupation conditions may properly be resolved in any case when handling the first factor of the protection. The plan should be written in simply British, so that all workers regardless of their academic level or background can comprehend it ... [a] plan should include a clear and accurate meaning of illegal nuisance so that workers know what type of perform is disallowed by the plan and will be able to identify that perform should it happen.

How Does a DUI Affect a Nurse in California?

Like many other states, California has a licensing board that regulates and licenses nurses.  The main licensing body in CA is the Board of Registered Nursing which is a branch of the Department of Consumer Affairs.  Any person who wishes to become an R.N. has to be approved by the Board.  There are numerous ways the state can punish nurses who are arrested for a DUI.  In addition to the criminal sanctions imposed by the courts, the state can and often will take action against a person who possesses a professional license such as a nurse or other medical professionals.

Any attempt to suspend a nursing license must start with the initiation of a disciplinary process.  The process is regulated by various California State Laws such as that found in Business and Professions Code section 2762,  which provides in pertinent part that a licensed nurse engages in unprofessional conduct when he or she uses alcoholic beverages "to an extent or in a manner dangerous or injurious to himself or herself, any other person, or the public," or is convicted of a criminal offense involving the consumption of alcohol.   According to California DUI Attorney Matthew J. Ruff, the Board will look closely at the police reports in any given case to determine if the conduct violates this law.  One way a DUI can implicate the relevant code is if the licensee's blood alcohol level was extremely high.  In california the law dictates that a BAC of .15 or higher should be construed as an aggravated offense.  A blood alcohol level is usually determined from a breath test or a blood test taken after the arrest.  However, Ruff explains that many tests can be successfully challenged on the grounds that the official standards were not followed or that the individual was below the per se level of intoxication at the time of driving, a theory referred to as the "rising blood alcohol defense".  Indeed, in one recent case, attorney Ruff related how he was able to have the DUI charge lowered for a client in nursing school due to violations of the testing protocol known as "Title 17".  One thing remains clear, if the BAC levels are not fought, the accused faces a difficult road as far as the state licensing board is concerned.

In one recent California Appellate Court case a Judge ruled that even a first offense DUI where the nurse had a blood alcohol level of .16  and was involved in an accident was enough to trigger a suspension that was brought by the licensing board or registered nursing.  The Court found that the facts of that case, notably the conviction for Vehicle Code section 23152, were substantially related to the duties and functions of a nurse.  What was interesting in that case was the fact that the registered nurse had no prior history of drunk driving or any alcohol abuse, no criminal record and was highly respected by her peers.

So where does this leave the average nurse that has the unfortunate luck to have been arrested for a DUI in California?  According to many attorneys who defend nurses charged with driving under the influence and other related criminal offenses, "do not plead guilty or no contest to any DUI without first consulting with an attorney".  Particularly in cases where a collision was involved or where the breath test reveals a blood alcohol level anywhere above a .14%.  The authorities seem to focus on these cases but any DWI arrest can trigger an investigation which will lead to a letter asking for information about the incident.

If the nurse pleads guilty or no contest in court, or fails to challenge the DMV action and there is any finding that a DUI was committed than the state can and will take action to suspend or revoke the person's nursing license.  Therefore, any health care professional, R.N., LVN, RPN, or anyone thinking about becoming a nurse in California,  facing an upcoming court date should proceed with caution.

HSBA reviews protect nominees and attorneys, while best serving the public interest

When the Hawaii State Bar Association board of directors rated Judge Katherine Leonard as -unqualified- to be chief justice of the Hawaii Supreme Court, it brought the organization's judicial review process into question. Many in the community thought the HSBA should have provided reasons for its decision.

In separate editorials, HSBA president Hugh Jones and past president Rai Saint Chu, defended the process. Jones stood on precedent, saying the process is the same as previous judicial reviews. Chu defended the good intentions of HSBA members who provided input and the careful and fair deliberation of the 20-member board.

The furor died somewhat when Associate Justice Mark Recktenwald received a -qualified- recommendation from HSBA, but there are several important facts that should be vetted before this controversy is put to rest. First, it's worth stating the obvious. HSBA is not the deciding entity in judicial nominations, merely one organization providing input to the Hawaii Senate Committee on Judiciary and Government Operations that then chooses whether to recommend confirmation of the nominee by the full senate. The senate committee incorporates HSBA's recommendation along with testimony from anyone in the community wishing to voice their opinion.

Secondly, HSBA makes its recommendation only after input from its 7,000-member body and an interview of the nominee. The recommendation appropriately comes without explanation. Why? It's not necessary. HSBA's intention is to state whether the nominee is prepared to serve, not to detail his or her strengths and weaknesses.

Providing detail behind the HSBA board decision, can only serve to hurt the nominee. For example, describing the nominee's adequate or inadequate administrative abilities, strong or weak leadership skills, erudite or lackluster legal knowledge, admirable or scandalous personal life, would at best be argumentative and at worst, embarrassing for the nominee. Whose benefits from this? No one.

The current process respects the career of the nominees. Comments regarding their professional and personal lives could easily be remembered long after they are accurate or even relevant. A nominee found to be unqualified this year, may be eminently qualified five years from now. Yet, he or she may never see a later opportunity for balanced public vindication unless the person is again nominated for a judgeship and reviewed by HSBA.

It has been noted, but not sufficiently appreciated, that any HSBA vote or detailed comments made public could lead the nominee to subtly or even subconsciously retaliate against those who voted or voiced opinions against him or her. The current procedure recognizes that attorneys must represent their clients before judges and anything that is prejudicial to the attorney and hence his client would be a disservice to both and diminish the integrity of our legal system. Divulging details of HSBA's deliberations of nominees could make attorneys have second thoughts about being candid regarding a nominee's weaknesses and instead offer only glowing adulations. This could undermine the very accuracy and value of HSBA's recommendation.

Rather than incomplete by not sharing more information, the current HSBA process appropriately provides the senate judiciary committee with the singular most important piece of relevant information. Whether the nominee is qualified for the judgeship. It is an appropriate complement to public testimony, including testimony by HSBA members at ratification hearings. The current process is both professional and in step with our local culture that rightfully believes it is inappropriate to unnecessarily speak poorly of another person.

In short, it is the best possible process for the nominee, the public and lawyers who represent their clients before the judiciary. It should not be changed.
